US Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks lawful basis.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to face alien smuggling charges, he was held in immigration detention.
In her order, the court noted that the authorities lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."
Context of the Case
The legal challenge center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in the state of Tennessee.
